2. Website use
This website provides general information about Hawk Dynamics and its B2B prospecting and appointment-generation services. You may use the site for lawful business purposes. You must not misuse the site, attempt unauthorised access, interfere with its operation, or use its content unlawfully.
3. Services
Hawk Dynamics may provide B2B prospect research, qualification, campaign setup, outreach preparation or support, reply and follow-up tracking, reporting, and related business-development services. The precise scope, deliverables, campaign limits, channels, client responsibilities and price will be confirmed in writing before paid work begins.
4. Founding pilot
Where offered, the founding pilot is a fixed 30-day B2B engagement at £400 unless a different scope or price is agreed in writing. The pilot purchases the agreed prospecting and outreach services for that period; it does not purchase or guarantee a particular commercial result.
Before work begins, we will confirm the campaign scope in writing. This may include the target customer profile, geography, exclusions, outreach channels, approval process and other agreed deliverables.
5. What counts as delivery
Hawk Dynamics delivers the service by carrying out the activities included in the agreed campaign scope with reasonable care and skill. Unless expressly included in the written scope, delivery is not measured by a guaranteed number of replies, meetings, sales or contracts.
A qualified opportunity, where that term is used, means a prospect that reasonably matches the agreed qualification criteria and has expressed a relevant level of interest or agreed to the next step specified in the campaign. A qualified opportunity is not a guarantee that the prospect will attend a meeting, purchase services or become a customer.
6. No guaranteed results
Sales and marketing outcomes depend on factors outside Hawk Dynamics' control, including market demand, prospect decisions, deliverability, timing, the client's offer, pricing and sales process. Unless expressly agreed otherwise in writing, we do not guarantee any minimum number of replies, qualified leads, meetings, sales, contracts, revenue or return on investment.
Dissatisfaction with campaign results, a low response rate, a prospect declining to proceed, a prospect cancelling or failing to attend a meeting, or the client's failure to convert an opportunity into a sale does not by itself mean that the service has not been delivered and does not by itself create a right to a refund.
7. Client responsibilities
Clients are responsible for providing accurate information about their services, ideal customers, exclusions and claims; giving approvals or feedback reasonably promptly where approval is part of the workflow; attending and handling sales conversations; following up opportunities appropriately; and telling us about legal, contractual or brand restrictions relevant to a campaign. Clients must not instruct us to carry out unlawful, misleading or deceptive activity.
Hawk Dynamics is not responsible for lost opportunities caused by the client's failure to respond, attend, follow up, provide required information or approvals, or otherwise perform its agreed responsibilities.
8. Compliance
We design campaigns with applicable UK data-protection and direct-marketing requirements in mind, including suppression and opt-out handling. The exact compliance requirements can depend on the channel, recipient and campaign. Each party remains responsible for its own legal and regulatory obligations and for information, instructions and systems under its control.
9. Fees, cancellation, complaints and refunds
Payment. Unless otherwise agreed in writing, the £400 pilot fee is payable in full before work begins. Payment reserves campaign capacity and authorises Hawk Dynamics to begin setup and delivery.
Client cancellation. A client may ask us to stop a campaign at any time. If the client cancels after work has begun, amounts attributable to work already performed, campaign setup already completed, and non-cancellable third-party costs reasonably incurred for the campaign are not refundable. Any refund of an unused balance will depend on the circumstances and the written campaign scope.
Change of mind or dissatisfaction. There is no contractual money-back guarantee based solely on a change of mind, subjective dissatisfaction, failure to achieve a desired response rate, number of meetings, sales, revenue or return on investment where Hawk Dynamics has performed the agreed services with reasonable care and skill.
Service problem. If a client believes Hawk Dynamics has materially failed to perform an agreed deliverable, the client should notify us at admin@hawk-dynamics.com, identifying the affected deliverable and the issue. We will investigate promptly. Where reasonably possible, the normal first remedy will be to correct, repeat or complete the affected work within a reasonable period.
Refunds for material non-performance. If Hawk Dynamics materially fails to provide an agreed part of the service and the failure cannot reasonably be corrected, repeated or completed, we may provide an appropriate refund or credit reflecting the affected and undelivered part of the service. This does not prevent either party from exercising rights or remedies that cannot lawfully be excluded.
Campaign suspension. We may pause or end work where continuing would reasonably risk unlawful activity, serious reputational harm, non-payment, abuse of our systems, or a material breach by the client. Where practical, we will explain the issue and give the client a reasonable opportunity to resolve a remediable breach.
10. Confidentiality
Each party should keep non-public commercial information received from the other confidential and use it only for the agreed business purpose, except where disclosure is required by law or the information is already lawfully public.
11. Intellectual property
Hawk Dynamics retains ownership of its pre-existing methods, templates, processes, know-how and general tooling. Once agreed fees are paid, the client may use campaign-specific deliverables created for it for its own internal business and sales purposes, unless a different licence or ownership arrangement is agreed in writing.
12. Third-party services
Our work may depend on third-party hosting, email, data, productivity, CRM, AI or other technology services. We are not responsible for outages, policy changes or failures of third-party services outside our reasonable control, although we will take reasonable steps to reduce disruption.
13. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, Hawk Dynamics is not liable for indirect or consequential loss, loss of profit, loss of anticipated business or decisions made by third-party prospects. Any specific liability cap for paid services should be set out in the applicable client service agreement.
14. Website information
We aim to keep website information accurate, but it may change without notice. Website content is general information and is not legal, tax, accounting or financial advice.
15. Governing law
These website terms and, unless a separate agreement states otherwise, our services are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply.
